Section 1 Title:
Border Enforcement Vehicle
Evasion Prevention Act.
Section 2: Penalties
(a) Any person found in
violation of this Act shall be subject to: A civil fine not exceeding $10,000;
Vehicle impoundment for up to 30 days; Criminal charges if evasion results in
injury, property damage, or obstruction of justice.
(b) Repeat offenders may be
subject to enhanced penalties, including permanent vehicle forfeiture and
imprisonment for up to 5 years.
(c) If death is caused to any
person in the process of committing this crime the imprisonment should be
anywhere from 20 years to life.
Section 3:
Motor Vehicle: Any
self-propelled vehicle designed for use on public roads, including cars,
trucks, motorcycles, and off-road vehicles.
Southern Border Zone: The
geographic area extending 100 miles north from the U.S. border with Mexico.
Evade: To intentionally flee,
elude, or avoid contact with law enforcement or immigration authorities.
Immigration Enforcement
Officer: Includes agents of U.S. Immigration and Customs Enforcement (ICE),
Border Patrol, and any local law enforcement officers acting in coordination
with federal immigration authorities.
Section 4. Prohibited Conduct
(a) It shall be unlawful for any person to operate a motor vehicle within the
Southern Border Zone with the intent to evade: An immigration enforcement
officer conducting a lawful stop, inspection, or apprehension; A local law
enforcement officer assisting or coordinating with federal immigration
authorities.
(b) Intent to evade may be
demonstrated by: Failure to comply with lawful orders to stop; Use of alternate
routes, off-road travel, or high-speed maneuvers to avoid detection; Use of
communication devices or coordinated actions to obstruct enforcement efforts.
Section 5. Purpose
To prohibit the use of motor
vehicles within 100 miles of the southern United States border with the intent
of evading lawful immigration enforcement actions conducted by federal or local
authorities.
Section 6. Exceptions. This Act
shall not apply to: Emergency medical transport; Lawful travel unrelated to
immigration enforcement; Individuals acting under duress or threat of harm.
Section 7. Enforcement and
Oversight. The Department of Homeland Security shall coordinate with state and
local agencies to implement enforcement protocols and training. Annual reports
shall be submitted to Congress detailing enforcement actions and outcomes.
